A comprehensive estate plan should include several legal documents. The
following is a listing of necessary documents for basic planning.
Revocable Living Trust Agreement and Portfolio
This is the main document of the estate protection plan.
When the Trust and all the ancillary documents are properly signed, dated,
notarized and funded, the estate will be protected from Probate, Conservatorship,
and there will be minimization or even elimination of the Federal Estate
Tax. All assets owned by the trust will be protected to the maximum extent
allowable by law.
Affidavit of Trust
This document verifies the existence of the trust. The
identity of who is in charge and acts to protect the privacy of your planning.
For most business reasons this will be the only document needed.
Certificate of Trust Existence
A simple statement of the existence of the trust and identification
of the current trustees.
Trust Instructions
This is a summary of the trust. It gives relevant informal
in-summary form about rights and responsibilities of the parties evolved
Durable Special Powers of Attorney for Funding
This is a power of attorney used to fund the trust. It enables the spouse and other agents to put assets in the trust.
Limited Miscellaneous Power of Attorney
This is a separate power of attorney that enables the
agents, in the event of mental disability, to make business decisions
for an incapacitated person.
Pour Over Wills
One separate Pour-Over Will for the husband and another
for the wife. The main purpose of the Pour-Over Will is to act as a "safety
net" for any assets that might inadvertently be left out of the trust.
Estate Tax Protection Provisions
Appropriate language to assure maximized use of unified
credits and the unlimited marital deduction.
Health Care Powers of Attorney
The Health Care Powers of Attorney names an agent to make
any necessary health care decisions for a spouse in the event that the
spouse is incapacitated and not able to make them, including life support
decisions
Anatomical Gift Forms
Directions for organ and tissue donation if desired
Memorial Instructions
Instructions as to funeral and memorial wishes
